1. Acceptance of Terms
By accessing or using Daino ("Daino", "we", "us") at www.dainokit.com and its related services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. We may modify these terms at any time; continued use after changes constitutes acceptance.
2. Description of Services
Daino provides a cloud platform offering the following services:
- CDN and content delivery
- Object storage and file hosting
- Managed databases (PostgreSQL)
- Container hosting (Vessel)
- Serverless functions and cron jobs
- Email sending and campaign management
- DNS management
- Redis and RabbitMQ instances
- Playwright browser automation
- Media processing and image optimization
- OpenClaw AI agent hosting
- MCP server hosting
3. Account Registration
- You must provide a valid email address and create a password to register
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must be at least 16 years of age to create an account
- One person or entity may not maintain more than one free account
- You must promptly notify us of any unauthorized use of your account
4. Billing and Payments
- Free tier services are provided at no cost, subject to usage limits
- Paid plans are billed on a recurring monthly basis via Stripe
- Credit top-ups are one-time payments; credits are non-refundable once used
- Unused credits do not expire and remain in your account until used
- Overage charges may apply if you exceed plan limits
- We reserve the right to change pricing with 30 days notice
- Failed payments may result in service suspension or downgrade to the free tier
5. Acceptable Use
You agree NOT to use our services to:
- Violate any applicable law or regulation
- Infringe on intellectual property rights of others
- Distribute malware, viruses, or malicious code
- Send unsolicited bulk email (spam)
- Host or distribute child sexual abuse material
- Conduct phishing, fraud, or identity theft
- Launch denial-of-service attacks or perform network abuse
- Mine cryptocurrency without explicit authorization
- Attempt to gain unauthorized access to our systems or other users' accounts
- Circumvent usage limits, rate limits, or resource quotas
- Resell or redistribute our services without written permission
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
6. Content and Data
- You retain ownership of all content you upload, store, or transmit through our services
- You grant us a limited license to host, store, and transmit your content solely for the purpose of providing our services
- You are solely responsible for the content you store and distribute
- We do not monitor content proactively but will act on valid abuse reports
- We may remove content that violates these terms or applicable law
7. OpenClaw and AI Services
- OpenClaw instances run in isolated containers with resource limits
- BYOK mode: you are responsible for your own LLM API key usage and costs with the provider
- Credits mode: LLM token usage is metered and deducted from your credit balance
- Instances with zero credit balance will be automatically stopped
- Runtime charges accrue per minute while an instance is active
- We are not responsible for outputs generated by AI models running on your instances
- You must comply with the terms of service of any third-party LLM provider you use
8. Service Level and Availability
- We strive for high availability but do not guarantee 100% uptime
- Scheduled maintenance windows will be communicated in advance when possible
- Free tier services are provided on a best-effort basis with no SLA
- We are not liable for data loss; you are responsible for maintaining your own backups
9. API Keys and Security
- API keys grant programmatic access to your account resources
- You are responsible for keeping API keys secret and secure
- Compromised keys should be revoked immediately via the dashboard
- We are not liable for unauthorized access resulting from leaked credentials
10. Termination
- You may close your account at any time by contacting us
- We may suspend or terminate your account for violation of these terms
- Upon termination, your data will be deleted within 30 days
- Prepaid credits are non-refundable upon voluntary account closure
- If we terminate your account for abuse, no refund will be provided
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAINO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use our services
- Any unauthorized access to or alteration of your data
- Any third-party conduct on our services
- Any other matter relating to our services
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Indemnification
You agree to indemnify and hold harmless Daino, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.
14. Governing Law
These terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
